Who needs a TM44 Air Conditioning Survey?

From January 2011, any building owner or manager in charge of any air conditioning systems that have an effective rated output of 12kW or more are required by legislation to have a TM44 air conditioning inspection carried out every 5 years.

If you have a number of systems that are individually less than 12kW, but together have a total collective effective rated output of more than 12kW, you will still need to comply with TM44 regulations.

What if I don't get a TM44 Air Conditioning Survey?

Fines of £300 per unit/building can be issued if you fail to keep, commission or provide an air conditioning report that has been lodged on the Central Register. Under the discretion of Trading Standards, these fines can be issued again on a daily, monthly, quarterly or annual basis.

In addition, if an officer of enforcement authority requests a copy of your air conditioning inspection report, a fixed fine of £200 per unit/building is issued if this can not be provided within seven days.

Following any penalties, it is important to instruct a surveyor to complete your TM44 air conditioning survey to avoid further fines. The enforcement officers routinely check the Government database to see if the reports have been lodged on the register.

What does the survey involve?

TM44 Air Conditioning Survey involves an in-depth survey on site, followed by production of report at the desk. The assessor will require access to all air conditioning systems to complete a visual survey of the systems. The assessor will also inspect any air conditioning tools and controls.

It would be beneficial if the facilities or business manager is available during the site survey should the assessor have any questions about the systems locations or operations.

What do I get?

After the site visit it takes about 10 working days to produce your TM44 air conditioning report. Your report will give advice and outline any steps you can take to improve the efficiency of the systems. Recommendations may include a suggested maintenance programme, operational changes or even details on a more efficient replacement system.

The potential cost savings from following the advice in the report could easily outweigh its initial cost, in addition to improving your environmental impact rating.

By following the recommendations, you could also improve the energy rating for the property, which will improve your rating the next time an Energy Performance Certificate (EPC) or Display Energy Certificate (DEC) is produced for the building.

How often do I need one?

It is compulsory to have regular inspections of your system, no more than 5 years apart.

If your system was first put into service on or after 1st January 2008, you must have your first air conditioning inspection carried out within 5 years of the date it was first commissioned as working.

If you air conditioning system has an effective rated output of more than 250kW, your first air conditioning inspection should have been carried out by 4th January 2009.

If you air conditioning system has an effective rated output of more than 12kW, your first air conditioning inspection should have been carried out by 4th January 2011.

If you have missed any of these deadlines then don't panic, having an inspection carried out and report produced now will not trigger any retrospective fines to be issued, but the sooner you have the survey carried out the better as it is highly likely you will start accumulating fines in the future if your building is not compliant.

Once we have provided you with a quote, if you wish to go ahead and book we will also need invoicing details and contact details for whoever is allowing access on site. We don't charge up-front, but will invoice you for the work on completion, and release the TM44 report to you upon receipt of payment. Our pricing includes the lodgement of the TM44 report on the government register, so the price we quote you is the total price you will pay.

After you have booked with us we will contact you or if you prefer an alternative site contact to arrange an appointment. Once we have visited site it takes us about 10 working days to produce the report, at which point we will contact you to let you know its ready and provide you with an invoice. On payment of the invoice we will email your TM44 report.
