The legal duty is identical, but what the assessment concentrates on is not. A purpose-built block usually has designed escape routes and compartmentation, so the questions are about management, maintenance and whether the building is still used as designed. An older conversion often has one original staircase and no second means of escape, so the fabric itself is under examination. Where a managing agent runs the building day to day, the duty usually sits with both the freeholder and the agent, because the Fire Safety Order attaches to anyone with control over the premises. In practice the assessment should name who is accountable for each action it raises, which is why a vague report is worth less than a specific one.
