MEES Regulation Changes for
Commercial Properties April 2023

Current Regulations

Current MEES (Minimum Energy Efficiency Standards) regulations state that new commercial tenancies cannot be granted unless the property has a valid EPC showing a score of E or above.

What's Changing?

From 1st April 2023, MEES regulations will apply to existing commercial tenancies, instead of just new tenancies.

What Does This Mean for Commercial Landlords?

Any commercial landlords that currently have existing tenancies where the property has an F or G rated EPC will need to either improve their properties to a minimum of an E rating, or successfully apply for an exemption on the PRS Exemption Register.

What Happens to Non-Compliant Landlords?

The penalty for non-compliance with MEES regulations is a financial penalty of up to £150,000.

How Can Landlords Improve Their Properties?

While they may have been provided with the default Recommendation Report, which is automatically generated with the EPC, it’s more advisable that landlords seek improvement advice that is tailored to their property and needs. This is as the advice is not specific to their property and therefore may not achieve the result required, especially if the recommendation report is older than 6 months.
