MEES Regulations for
Commercial Properties April 2023 Update

Last year, Minimum Energy Efficiency Standards (MEES) regulations changed for commercial properties. In this article we discuss the changes, and tell you everything you need to know as a commercial property owner, agent or landlord.

Previous Regulations

Prior to the changes, MEES regulations stated that new commercial tenancies could be granted unless the property has a valid EPC showing a score of E or above.

Recent Changes

Since 1st April 2023, MEES regulations have applied to existing commercial tenancies too, instead of just new tenancies.

What Does This Mean for Commercial Landlords?

Any commercial landlords that have existing tenancies where the property has an F or G rated EPC will now need to either improve their properties to a minimum of an E rating, or successfully apply for an exemption on the PRS Exemption Register.

What Happens to Non-Compliant Landlords?

The penalty for non-compliance with MEES regulations is a financial penalty of up to £150,000.

How Can Landlords Improve Their Properties?

While they may have been provided with the default Recommendation Report, which is automatically generated with the EPC, it’s more advisable that landlords seek improvement advice that is tailored to their property and needs. This is as the advice is not specific to their property and therefore may not achieve the result required, especially if the recommendation report is older than 6 months.
